This document outlines the terms and conditions, as well as the privacy policies applicable to the use of services offered by FARIDE on the website www.faride.com.co and other related domains. Any person subscribing to www.faride.com.co or wishing to use the services offered is entitled to do so but must adhere to the terms and conditions and privacy policies outlined in the document "Terms and Conditions." These sales terms and conditions will be governed by the laws applicable in the Republic of Colombia. Any dispute arising from this document will be subject to the competent jurisdiction in accordance with Colombian legislation, and both FARIDE and the customer expressly waive any other jurisdiction that may correspond to them due to their present or future domicile.

It is necessary for the user to READ, UNDERSTAND, and ACCEPT all the conditions set forth in this document before registering as a user or acquiring products or services through www.faride.com.co. By using this site, the user fully accepts the conditions outlined in the Terms and Conditions and Privacy Policies of FARIDE, and therefore, the user is obliged to comply with all the pre-established conditions without being able to plead ignorance of such Terms and Conditions and Privacy Policies.

SECTION 1 – LEGAL CAPACITY

The services offered by FARIDE are only available to individuals with the legal capacity to contract. The actions performed by minors on this site will be the responsibility of their parents or guardians, and therefore, they will be considered performed by them and the legal representation they have. Anyone choosing to register as a company must have the full capacity to contract on behalf of the entity and, consequently, bind it to the terms set out in the document "Terms and Conditions."

SECTION 2 – REGISTRATION AND SITE USE

To become an authorized user of www.faride.com.co, purchase products, and access the promotions offered on the site, it is necessary to complete the registration form in all mandatory fields with valid data accurately, precisely, and truthfully. The user undertakes to update the personal data used when completing the registration form as necessary. FARIDE is not responsible for the accuracy of the personal data provided by its users. Each user is responsible for the accuracy and truthfulness of the personal data entered into the system. Each natural and/or legal person can only be the holder of one account on www.faride.com.co. If a person modifies or alters their personal data in any possible way to access more than one account, and fraudulent or malicious use is suspected or verified, www.faride.com.co has the irrevocable right to terminate the credits of this user, disable their accounts in the system, and legally pursue the infringers.

FARIDE has the right to request additional data or proof to verify the personal data entered by users. It also has the right to temporarily or permanently suspend users whose data is not confirmed and who refuse to provide requested proof or additional data. If a user is suspended, FARIDE may retract a purchase made by the user without the right to compensation.

When a new member registers, they will have their email address or username and a personal password that allows confidential and secure access to the www.faride.com.co page. The user assumes full responsibility for keeping their password confidential, as it allows them to make purchases and obtain personal information. Delivering the user's personal password to third parties does not involve FARIDE's responsibility. The user is responsible for all operations carried out from their account, and their access password must be for personal and exclusive use. It is the user's responsibility to notify FARIDE immediately of any unauthorized use of their account or password. Selling, lending, or transferring a password or account between users is strictly prohibited.

FARIDE reserves the right to reject any registration request or to cancel a previously accepted registration at any time without being obliged to explain the reasons for its decision and without generating any right to compensation.

SECTION 3 – AGREEMENT MODIFICATIONS

FARIDE may modify the Terms and Conditions at any time. The modified terms will come into effect 10 days after their publication. Within the first 5 days after publishing the new modifications, the user must contact www.faride.com.co by email if they do not accept the new Terms and Conditions. In case they do not accept them, the user will be disabled as a member. If the 5-day period expires, it will be considered that the user accepts the new Terms and Conditions, and the contract between both parties will not be affected.

SECTION 4 – PAYMENT METHOD

The products and services offered on www.faride.com.co can only be paid for using the methods indicated in each specific case. The use of credit cards is subject to what is established in these Terms and Conditions and to what is agreed in the respective cases of opening contracts and usage regulations with their issuer. FARIDE may determine purchase conditions according to the payment method chosen by the user. FARIDE has the right to determine the maximum amount of credits that the user can use per purchase, and the user will be notified before starting the payment process. The credits used by users will not be refunded in case of product returns.

SECTION 5 – FORMATION OF CONSENT IN CONTRACTS MADE THROUGH THIS SITE

Through www.faride.com.co, offers of goods and services will be made that can be accepted using the mechanisms offered. Any acceptance of an offer by a user is subject to a suspensive condition until the transaction is validated. For any operation carried out on www.faride.com.co, validation by the provider is a requirement for the formation of consent. To validate each transaction, it must first be verified that the payment method offered by the user is valid, the data registered by the customer on the site matches what was provided when accepting the offer, and that the payment is credited by the user. To inform the user about the validation of the offer, a confirmation will be sent to the same email address that the user registered when subscribing. The consent will be deemed formed from the moment this written confirmation is sent to the user and in the place where it was issued.

The sale and delivery of products are subject to their availability. If, for any reason, a product is not available, and the customer was able to make a purchase of this unavailable product, the customer will be notified immediately, and the total value of the price paid for the product will be reimbursed.

SECTION 6 – VALIDITY PERIOD OF THE OFFER AND PRICE

Offers on www.faride.com.co will be valid until the expiration date indicated in the promotion or until the quantities of products available for that promotion are exhausted. When no expiration date is indicated in a promotion, it will be understood that the offer will exist until the corresponding inventories are exhausted. The prices of products and services published on www.faride.com.co will only be valid for purchases made through this means. They will not be valid for other sales channels. All prices are expressed in Colombian pesos. The prices offered do not include transportation, handling, shipping, and accessories that are not expressly described in the product descriptions.

It is possible that some products may have an incorrect price. If a typographical error is identified in any of the product prices, customers will be contacted before dispatching the products, and they will be notified of the error. The products will not be sent until the correct price is paid.

SECTION 7 – PROMOTIONS

Promotions offered on www.faride.com.co will not be valid in other sales channels. When promotions consist of reducing the price or sending a product for free with the purchase of another, both products must be delivered to the same location. Suppliers submit their promotions to the provisions of Law 1480 of 2011.

When discount coupons are offered, the coupon value, the minimum purchase amount to use the coupon, and the dates on which it can be used will be clarified. Coupons can be used by any natural person over 18 years of age. Coupons are not cumulative with other promotions and can only be used once per customer. The maximum purchase amount for coupon use is one million pesos.

SECTION 8 – PRODUCT DISPATCH

Products purchased through our FARIDE Marketplace are subject to the shipping conditions chosen by the user and the delivery conditions available on our Marketplace. The user will freely choose the delivery address.

After the payment is approved and the order is dispatched, FARIDE will communicate the delivery date to the customer via email.

In case no one receives the order at the shipping address, a second attempt will be made over the next three days. If, after this attempt, no one receives the order, the user must contact our Marketplace at the email address faridedesde1965@gmail.com, and the cost of the new shipment is borne by the customer. If the customer does not make a new shipment within the following 5 days after the second attempt, the product is declared abandoned, and there will be no compensation. In such a case, FARIDE will not be responsible for the unreceived products.

If the customer chooses cash on delivery and does not pay the full amount of the product and pre-established shipping in the order, it is understood that there is a breach of the contract, and the customer must pay the corresponding amount for the return of the products.

It is understood that anyone present at the location specified by the customer for product delivery is authorized to receive the order; therefore, FARIDE is exempt from any claims arising from delivery at the location specified by the customer.

SECTION 9 – RETURN AND CANCELLATION POLICY

RETURNS OR REFUNDS (RIGHT OF WITHDRAWAL)

FARIDE offers its customers the possibility to withdraw from the purchase during the first 3 business days after the product's delivery.

The process to request a withdrawal is as follows:

  1. Send an email before the 3 business days after receiving the product to faridedesde1965@gmail.com, stating the reason for the return and whether you require an identical product, a different one, or a refund. Note: It is essential to be very specific about the reasons for the return.
  2. After the email is reviewed by FARIDE, the customer will receive an email with a reverse logistics guide.
  3. The customer has 3 days after receiving the reverse logistics guide to take the product to the address indicated by FARIDE.
  4. The product must be in perfect condition and in its original packaging, including all packaging and labels.
  5. When the product is received, the provider performs the quality control, which takes approximately 3 business days. When the product's condition is determined, and the change or refund is authorized, we will proceed with the option chosen by the customer.
  6. Money refunds will only be made by bank transfer to the account specified by the customer.

WRONG PRODUCTS

If the customer receives a product with different characteristics than described on the website at the time of purchase, the procedure to request a product change is as follows:

  1. Within 2 days after receiving the product, the customer must take photos showing the wrong product and send them to the email faridedesde1965@gmail.com with the order number.
  2. Once it is verified that the product arrived incorrectly, a collection guide will be sent to the customer, and FARIDE will arrange to collect the product at the same location where it was delivered. Once the incorrect product is collected, the correct product will be sent. No money refunds are made; instead, a voucher will be issued, valid for 6 months from the validation of the change.

CANCELLATIONS

The cancellation of a purchase is only carried out if the provider is unable to send the product to the customer due to lack of inventory and/or other force majeure reasons. In such a case, the customer will be notified, and the money will be refunded. The refund times vary depending on the payment method used.

The customer can choose between the following refund methods:

  1. Voucher: Vouchers are valid for one year and must be used in a single purchase. The delivery time for this refund is 2 business days.
  2. Bank Transfer: The account holder must be the same as the one who made the purchase on www.faride.com.co. The refund will be made within 3 business days.

To cancel an order for any reason, the customer must write an email to faridedesde1965@gmail.com with the order number they want to cancel. Orders can only be canceled if they have not yet been shipped by the provider, or in the case of payment through the PayU payment gateway, the customer assumes the commission costs generated.

SECTION 10 – INTELLECTUAL AND INDUSTRIAL PROPERTY

All content available to the user on www.faride.com.co, including intellectual and industrial property, is the exclusive property of FARIDE or the companies supplying the products. Users must refrain from reusing the content of www.faride.com.co without the prior consent of FARIDE.

SECTION 11 – THIRD-PARTY INTELLECTUAL PROPERTY

FARIDE has tools to ensure that products acquired using our services are original and have been legally imported into the country. If you, as a user, suspect that any product published on www.faride.com.co infringes intellectual property or legal rights, please notify us at the email address faridedesde1965@gmail.com for review.

SECTION 12 – RESPONSIBILITIES

FARIDE will not be responsible for losses of business opportunities or any indirect damage caused by the interruption of site transmission. Every effort will be made to keep the transmission free of errors and interruptions, but such conditions cannot be guaranteed. User accounts may be restricted or temporarily suspended for maintenance or to introduce improvements to the site.

SECTION 13 – NOTIFICATIONS
